آزادىهاى اساسى است. مادّهى 3 اين كنوانسيون به بحث
ممنوعيّت شكنجه، و ديگر رفتارها يا مجازاتهاى غيرانسانى، بىرحمانه و ظالمانه
مىپردازد. [1] دادگاه و كميسيون اروپايى حقوق بشر، محتواى اين مادّه را توسعه داده، و تنبيه
بدنى كودكان را داخل و در محدودهى اين مادّه قرار داده است؛ و بيان داشته است
تنبيه و مجازات بدنى كودكان نقض مادّهى 3 به شمار مىرود. [2] به

محوطه مدرسه مشاهده كرد، و به همين خاطر او را مورد تنبيه بدنى قرار داد و با عصا

به دادگاه اروپايى حقوق بشر شكايت كرد؛ دادگاه اروپايى اين عمل را نقض مادّهى 3
دانسته، و چنين عملى را يك رفتار تحقيرآميز و غيرانسانى
