Abstract
The international human rights system seeks to ban, in
the light of the documents about prohibition of corporal punishment of
children, the use of all kinds of corporal punishments on children. All forms
of corporal punishments as being against the human dignity and a childs
physical integrity and which come into the category of inhuman, cruel and
sometimes torturous acts, have been prohibited in three levels: family, school
and penal system. Thus the states have been asked to take measures to prevent
such punishments on children. On the other hand, the Islamic approach as per
the Imamiyah jurisprudence has considered corporal punishment as permissible
and has allowed certain individuals such as the ruler( qualified jurisprudent
), father and teacher to use corporal punishment for educational discipline of
a child and observance of his/ her best interest.
This variation has led to some challenges between these
two systems. Therefore, in order to iron out the challenges, I have made a
study of the views of the two systems on corporal punishment. In the beginning,
I have provided the definitions of relevant technical terms and expressions,
and found out that corporal punishment is the deliberate infliction of pain
