رسيد؛ هرچند كميسيون آمريكايى تأكيد داشته است كه كشورها و دولت‌هاى عضو، بايستى كنوانسيون كودكان را مورد پذيرش قرار دهند؛ و هر خشونتى را كه هدفش كودكان است، منع نمايند. [1] از اين رو، كنوانسيون آمريكايى- همانند كنوانسيون حقوق كودك- مجازات بدنى كودكان را به طور مطلق منع مى‌كند.

7. منشور اجتماعى اروپايى‌ [2]

دبير كلّ شوراى اروپا، خانم «ماد دِبور- بوكوئيكچيو» [3] در سال 2002 م پيشنهادى را براى كشورهاى عضو اين شورا فرستاد مبنى بر اين‌كه ممنوعيّت خشونت عمدى عليه كودكان به عنوان مجازات بدنى قانونمند شود؛ و پذيرفته شود كودكان نيز همانند بزرگسالان داراى حقوق انسانى اساسى هستند و نبايد مورد آزار و تهاجم قرار گيرند. او دولت‌ها را متوجّه ساخت كه تمام انسان‌ها مستحقّ احترامند و كودكان به عنوان جوان‌ترين و ضعيف‌ترين انسان‌ها، به خصوص، شايسته‌ى تعهّد بزرگان به اين حقّ هستند. [4] وى توجّه نمايندگان دولت‌ها را در اين رابطه به مادّه‌ى‌
